Definitions and Interpretation

In these Terms and Conditions, unless otherwise indicated:

Agreement means these Terms and Conditions, our Privacy Policy, and any other agreement you enter into with us.


Australian Consumer Law
means the law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).


Brief
means the de-identified clinical summary generated from your survey responses to help your Wellness Team prepare for your consultation.


Clinic Services
means the telehealth health services we provide through Health Care Practitioners, including initial and follow-up consultations.


Fee
means the fee or fees we charge for provision of Clinic Services.


Health Care Practitioners
means Staff comprising medical practitioners (doctors) and registered nurses.


Medicine
means any medicine prescribed by a Health Care Practitioner through our Platform.


Patient Brief Survey
means the online questionnaire through which you provide your health history and presenting concerns prior to a consultation.


Pharmacy
means any one or more of the partner pharmacies we engage with to supply Medicine to you.


Platform
means our websites, clinic portal, patient brief system and any other digital platforms through which we provide the Services, including clinic.peaceandquiet.au.


Services
means the Clinic Services, the Platform, and all associated services as described in these Terms.


Site
means peaceandquiet.au and any associated subdomain.


Staff
means people employed by or contracted to us to provide the Services.


User Content
means any information or content you submit to, or use with, the Platform or Services, including your Patient Brief Survey responses, profile information, and any communications.


Wellness Team
means your assigned Health Care Practitioners and supporting staff at Peace & Quiet.

Terms of Use

Peace & Quiet Pty Ltd (ABN 52 691 934 059) (Peace & Quiet, us, we, or our) own and operate the Platform and Site. Access to and use of the Site and the Services available through the Platform (collectively, Services) is subject to the following terms, conditions and notices (Terms of Use). By using the Services, you agree to all of the Terms of Use, as may be updated by us from time to time. You should check this page regularly to take notice of any changes.


The Platform provides you with access to consultations with registered Health Care Practitioners. Peace & Quiet facilitates this access and is not responsible for the clinical advice provided by individual practitioners, nor does it make representations about the suitability of any advice provided. The Platform may also facilitate access to Pharmacies for dispensing of any Medicine prescribed. Peace & Quiet is not responsible for the quality or suitability of those products.

Amendment of the Terms of Use

Peace & Quiet reserves the right to amend these Terms at any time. Any changes will be published on the Site. Amendments will be effective upon publication. Your continued use of the Services represents your agreement to be bound by the amended Terms.

Linked Sites

The Site contains links to other websites not owned or operated by Peace & Quiet, for your information and convenience. Peace & Quiet has no control over websites it does not own or operate and accepts no responsibility for any loss or damage that may arise from your use of those websites.

Privacy Policy

Our Privacy Policy sets out how we collect, use, store, disclose and dispose of your personal and health information. By using the Site, you consent to the collection, use and disclosure of your information in accordance with our Privacy Policy, which can be found at www.peaceandquiet.au/privacy-policy.

Intellectual Property

a. Apart from any use permitted under the Copyright Act 1968 (Cth), you must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute content on the Site in any way, except as expressly provided on the Site or authorised in writing by Peace & Quiet. This prohibition covers all text, graphics, logos, photographs, audio or video material available on the Site.

b. Excluding User Content, all intellectual property rights in the Site and Services are owned by Peace & Quiet or its licensors. The provision of the Services does not transfer to you or any third party any rights, title or interest in those intellectual property rights.

c. Copyright/Trademark Information.  Copyright © 2026, Peace & Quiet Pty Ltd. Peace & Quiet™ and the Peace & Quiet logo (collectively, Marks) are trademarks of Peace & Quiet Pty Ltd. You may not use our Marks or any third-party marks displayed on our Site without prior written consent from Peace & Quiet or the relevant owner.

Eligibility

You must be 18 years of age or over to use the Clinic Services. Our Clinic Services are only available to persons currently residing in Australia with a valid Australian residential address.

Accounts and Access

a. To access certain features of the Platform (including completing a Patient Brief Survey and booking a consultation), you will be required to provide information about yourself. You represent and warrant that all information you submit is complete and accurate, and you will maintain its accuracy at all times.

b. You may not create more than one account on the Platform.

c. Peace & Quiet may suspend or terminate your account in accordance with these Terms.

d. You may request deletion of your account at any time by contacting hello@peaceandquiet.au with your name and email address.

e. You are responsible for maintaining the confidentiality of your account credentials and secure survey access links. You are fully responsible for all activities that occur using your credentials or links. You must notify us immediately of any unauthorised use or breach of security. Peace & Quiet is not liable for any loss or damage arising from your failure to comply with these requirements.

Eligibility for Clinic Services

Our Clinic Services are only available to you if you:

•     are over 18 years of age

•     are currently residing in Australia with an Australian residential address

•     are accessing the Services for yourself, or have the legal authority to act on behalf of another person

•     have the legal right, authority and capacity to agree to and abide by these Terms

You warrant that each of these matters is true and correct each time you use our Services.

Accurate Information

You must provide accurate, current and complete information about yourself when using our Platform and Services, including your full name, date of birth, contact details, medical history and any other information reasonably required for us to provide the Services safely and effectively. You must update this information to maintain its accuracy. If you provide incomplete or inaccurate information, we may be unable to provide the Services to you.

Access and Security

You must notify us immediately if you become aware of any unauthorised use of the Platform in your name or any other breach of security. When using the Platform you must:

•     maintain the confidentiality of your account credentials and any secure survey access links

•     take all reasonable steps to ensure no third party gains access to the Platform in your name

•     use a secure and private environment to protect the confidentiality of your information

Appropriate Use

When using the Platform and our Services you agree that:

•     you will not use our Services to engage in any fraudulent or unlawful activity

•     you will not share inappropriate, offensive or illegal content

•     you will treat all Staff, and any staff of our partners and suppliers, with respect and courtesy, and will not use abusive or threatening language or behaviour

•     you will not attempt to deceive or mislead our Staff or the staff of our partners or suppliers in any manner, including in the course of receiving Clinic Services

•     you will not share your secure Patient Brief Survey link with any other person

Authorised Representative

You may nominate a representative to assist you in your dealings with us (Authorised Representative), including assistance with enquiries and scheduling of consultations. If you require support during a consultation, please contact us at hello@peaceandquiet.au as additional documentation may be required. You are solely responsible for the conduct of your Authorised Representative in using our Services.

Patient Brief Survey

a. Purpose.  The Patient Brief Survey captures your health history and presenting concerns to help your Wellness Team prepare for your consultation. Completing it accurately is essential to receiving safe and appropriate care.

b. Secure access links.  Your survey is accessed via a unique secure link sent to your email address. This link is personal to you, valid for 48 hours, and can only be used once — it is automatically invalidated upon submission. You must not share your link with any other person. If your link expires before you complete the survey, contact hello@peaceandquiet.au for a new one.

c. Automated Brief generation.  Your survey responses are processed by an automated algorithm to generate your Brief. This processing involves only your de-identified clinical responses — no personally identifiable information (such as your name, email or date of birth) is included. All processing occurs within Australian infrastructure. By submitting the survey, you consent to this processing as described in our Privacy Policy.

Payment of our Fees

We charge Fees at the price advertised on our Platform from time to time. Our Fees do not include the cost of any Medicine prescribed or Medicine delivery, which you purchase separately from a Pharmacy.

You agree to pay our Fee for each consultation at the time of booking. We will refund your Fee:

•     for your first use of our Clinic Services, where a Health Care Practitioner determines in their absolute discretion that our Clinic Services are not appropriate for you in your circumstances, or

•     if we cancel an appointment and are unable to reschedule within a reasonable time.

We will not refund Fees in any other circumstances. Refunds will be provided within a reasonable timeframe in the same manner as payment was made.

Clinic Services — Your Obligations

You agree that:

•     it is your responsibility to follow any treatment plans and medical advice provided by your Health Care Practitioners, including attending follow-up appointments as recommended.

•     if you experience any adverse reactions or side effects from any Medicine prescribed, you must promptly inform us.

•     our Clinic Services are not intended to be a substitute for the ongoing involvement of your primary or other specialist health care practitioners. You agree to maintain connection with your community health care practitioner

•     if a Health Care Practitioner advises you to obtain further healthcare services, it is your responsibility to do so within the timeframe advised. Neither we, nor the Health Care Practitioner, are responsible for ensuring that you do so.

•     Medicine is strictly for your own personal use. You are responsible for ensuring that no other individual accesses or consumes Medicine prescribed to you.

•     all prescriptions are written at the sole discretion of the prescribing Health Care Practitioner, who may decline to issue a prescription for any reason. Prescribers may request supporting documentation before issuing any prescription.

Pharmacy Facilitation

We work with partner Pharmacies to facilitate the ordering and delivery of Medicine prescribed through our Platform. Where you authorise us to do so, we will provide your prescription and relevant information to our pharmacy partners solely for the purpose of dispensing and delivering your Medicine. You authorise us to share all information reasonably required by a Pharmacy to supply your Medicine. The terms and conditions of our partner pharmacies apply to all Medicine transactions.

Release of Prescription

You may request in writing that your prescription be released to a pharmacy of your choosing. We will endeavour to provide the prescription to your nominated pharmacy within a reasonable timeframe at the address you provide in writing.

Disclaimers

a. Subject to any non-excludable consumer guarantees under the Australian Consumer Law, the material displayed on the Site is provided without any guarantees, conditions or warranties as to its accuracy.

b. All information on the Site and through our Services is for informational purposes only and is not a substitute for professional medical or health practitioner consultation.

c. Peace & Quiet is not responsible for your relationship with any Health Care Practitioner, third party, or other users of the Site or Services.

d. Peace & Quiet is not obliged to screen Health Care Practitioners to determine whether they are qualified or authorised by law to provide their services, or to determine the accuracy of the information they provide. All practitioners are independently registered and regulated by AHPRA.

e. Any information accessed through the Site or Services is for informational and educational purposes only and is not intended to be a substitute for medical advice, diagnosis or treatment.

f. All information on the Platform is supplied without warranty. Information is not intended to diagnose, treat, cure or prevent any disease, injury or illness. Nothing on the Platform, other than communications with your Health Care Practitioner, constitutes medical advice. You take full responsibility for what you do with this information and any resulting outcomes.

Indemnity

a. In this clause, a reference to Peace & Quiet includes its officers, directors, contractors, employees and agents.

b. You agree to indemnify and hold Peace & Quiet harmless from any and all losses (including reasonable legal costs and expenses) or liabilities arising from any claim, demand, suit, action or proceeding by any person against Peace & Quiet arising from, in connection with, or in respect of:

(i)  your violation of these Terms

(ii)  your publication or distribution of any material or information through the Platform

(iii)  your infringement of the intellectual property rights of any third party

(iv)  any violation of law by you

c. Subject to any consumer guarantees under the Australian Consumer Law that cannot be excluded, in no event shall Peace & Quiet be liable to you or any third party for any lost profit, or any indirect, consequential, exemplary, incidental, special or punitive damages arising from this Agreement or from your use of, or inability to use, the Site or Services.

Access and Use of the Platform

a. Licence.  Subject to these Terms, Peace & Quiet grants you a non-transferable, non-exclusive licence to use the Platform and Services for your personal, non-commercial use only.

b. Restrictions.  The rights granted to you are subject to the following restrictions. You must not:

(i)  licence, sell, rent, lease, transfer, assign, distribute, host or otherwise commercially exploit the Platform or Services

(ii)  modify, make derivative works of, disassemble, reverse compile or reverse engineer any part of the Platform or Services

(iii)  access the Platform or Services in order to build a similar or competitive service

Modification

Peace & Quiet reserves the right to modify, suspend or discontinue the Platform or Services, or any part thereof, at any time with or without notice. Peace & Quiet will not be liable to you or any third party for any such modification, suspension or discontinuance.

Communications

a. Where you have provided your phone number, you agree that Peace & Quiet and those acting on its behalf may send you text (SMS) messages for appointment reminders and clinical communications. Standard messaging charges applied by your carrier may apply.

b. You may opt out of non-essential text messages at any time by contacting hello@peaceandquiet.au or as instructed in any message.

c. Where you have provided your email address, you agree that we may send you emails concerning our Services. You may opt out of promotional emails by following the unsubscribe instructions in any such email.

User Content

a. Peace & Quiet is not responsible for any User Content, including its accuracy, completeness, timeliness, validity, legality or quality. Peace & Quiet does not assume and will not have any liability or responsibility for your use or misuse of any User Content.

b. You agree not to submit User Content that:

(i)  violates any third-party right, including any copyright, trademark, patent, trade secret, privacy right or any other intellectual property or proprietary right

(ii)  is unlawful, harassing, abusive, threatening, harmful, defamatory, false, intentionally misleading, obscene, offensive or otherwise objectionable

(iii)  is in violation of any law, regulation, or restriction imposed by any third party

c. By submitting User Content, you grant Peace & Quiet an irrevocable, non-exclusive, royalty-free, worldwide licence to use your User Content solely for the purposes of providing the Services to you.

Feedback

If you provide Peace & Quiet with any feedback or suggestions regarding the Platform or Services (Feedback), you assign to Peace & Quiet all rights in the Feedback. Peace & Quiet may use Feedback in any manner it deems appropriate. Peace & Quiet will treat all Feedback as non-confidential and non-proprietary.

Acceptable Use Policy

a. You agree not to use the Platform or Services to:

(i)  upload, transmit or distribute any computer viruses, worms or software intended to damage or alter a computer system or data;

(ii)  send unsolicited or unauthorised advertising, spam, chain letters or any other form of duplicative or unsolicited messages;

(iii)  harvest, collect or assemble information regarding other users without their consent;

(iv)  interfere with, disrupt or create an undue burden on servers or networks connected to the Platform;

(v)  harass or interfere with another person's use and enjoyment of the Platform or Services;

(vi)  introduce software or automated agents to the Platform to produce multiple accounts, generate automated searches or scrape data;

b. We reserve the right to investigate and take appropriate action (including suspending or terminating your access) if we suspect you have violated this Acceptable Use Policy or any other provision of this Agreement.

Third-Party Interactions

During use of the Platform, you may interact with third-party service providers including Health Care Practitioners, Pharmacies and booking platforms. Peace & Quiet is not a party to any transaction between you and a third party. Any such activity and any terms associated with it are solely between you and the applicable third party. Peace & Quiet has no liability for any correspondence, purchase or transaction between you and any third party.

Third-Party Materials

The Platform may display, include or make available third-party content or links to third-party websites and services (Third-Party Materials). Peace & Quiet is not responsible for Third-Party Materials, including their accuracy, completeness, validity, legality or quality. Third-Party Materials are provided for convenience only and you access them entirely at your own risk. The third party's own terms and privacy practices apply.

Term and Termination

a. This Agreement will remain in full force and effect while you use the Platform or Services.

b. We may suspend your access to the Platform or terminate this Agreement at any time, for any reason, at our sole discretion, including for any use of the Platform or Services in violation of this Agreement. Upon termination, your access to the Platform and Services will cease immediately.

c. Even after this Agreement is terminated, the provisions capable of continuing in effect will survive termination.

Jurisdiction

This Agreement is governed by the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts located in New South Wales.

Dispute Resolution

a. Pre-dispute resolution.  We are committed to resolving disputes amicably and efficiently. Attempts to informally resolve any dispute must be exhausted before formal proceedings are commenced. Most concerns can be resolved quickly by contacting us at hello@peaceandquiet.au. If informal resolution is unsuccessful, a party intending to commence proceedings must first notify the other in writing.

b. Confidentiality.  All aspects of any dispute resolution process and any ruling, decision or settlement will be strictly confidential for the benefit of all parties.

c. Regulatory complaints.  If your complaint relates to the conduct of a Health Care Practitioner, you may also contact the Australian Health Practitioner Regulation Agency (AHPRA) at www.ahpra.gov.au. Privacy complaints may be directed to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.

Booking Policies
Consultation Cancellations

Your appointment is important to us and is reserved especially for you. We understand that life can sometimes get in the way. Should you need to change or cancel your appointment, we ask that you provide a minimum of 24 hours' notice. This allows your practitioner to offer your allocated time to another patient. You may be charged a cancellation fee equal to the cost of the consultation for any missed or cancelled appointments where less than 24 hours' notice is given.

Consultation Refunds

Consultation fees are charged at the time of booking. These fees are non-refundable except in the circumstances set out under "Payment of our Fees" above.

Prescription Delivery

Dispatch, delivery and refunds of prescription products are governed by our partner pharmacies' terms and conditions and any other relevant policies. By accessing pharmacy services through Peace & Quiet, you agree to be bound by those terms and conditions.

Partner Pharmacy Terms of Sale

We work with independent partner pharmacies to fulfil your prescription. All goods purchased from our partner pharmacies are subject to the following terms.

Acceptance of Goods

To ensure your privacy and the safe delivery of your products, pharmacy deliveries may require a signature upon acceptance. Prescription products cannot be given an authority to leave direction. If no one is present to accept delivery, your package will be taken to the nearest collection point and a card left with collection instructions.

Title and Risk

Title to the goods passes to you when your order leaves the dispensing pharmacy. From that point, you are the legal owner of the products and they are at your risk.

Returns and Refunds

Our returns policy applies in addition to your rights under the Australian Consumer Law. Unfortunately, refunds are generally not available on prescription items due to state health regulations — these products cannot be returned to stock or re-sold after leaving the pharmacy premises, as storage conditions and effectiveness of the medication cannot be guaranteed.

Please contact us immediately if your item is:

•     faulty or not as described

•     significantly different to what was advertised

•     unsafe or not of acceptable quality

We and our partner pharmacy reserve the right to return the product to the manufacturer for evaluation before providing a refund or replacement. No refund will be provided if the item was damaged due to misuse or neglect. No returns, refunds or exchanges are available for change of mind.

Damaged or Incorrect Products

Please contact us within 3 days of receiving your products if your order arrived damaged or if the incorrect item was delivered. You may be required to provide an image of the damaged or incorrect product. We will cover the cost of return freight in these circumstances.

General

We may amend these Terms at any time. All amendments are effective from the date they are published on the Platform or otherwise notified to you. By continuing to use the Services, you agree to be bound by the amended Terms.

These Terms set out the entire agreement between you and us in relation to the Services and your use of the Platform.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be treated as severed from these Terms, and the remaining provisions will continue in full force and effect.

We may assign our rights and transfer our obligations under these Terms. You must not assign your rights or transfer your obligations without our prior written consent.
